Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the 0110 Design platform (the "Service") operated by 0110 Design ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

1. Nature of the Service

0110 Design operates strictly as an intermediary digital marketplace and directory. We provide a platform designed to connect clients ("Clients") with independent architects, interior designers, and specialized design professionals ("Professionals").

We are not an architecture firm, engineering firm, or design agency. We do not provide architectural, engineering, contracting, or construction services.

2. No Guarantee or Warranty on Professional Services

While 0110 Design implements a vetting process for Professionals listed on the platform, we make absolutely no representations, warranties, or guarantees regarding the quality, safety, legality, or suitability of the services provided by any Professional.

• Project Outcomes: We do not guarantee that any project will be completed to your satisfaction, successfully secure permits, or meet building codes.
• Budgets & Timelines: We hold zero liability for project delays, budget overruns, material costs, or failure to meet deadlines.
• Contractual Independence: Any agreement, contract, or transaction formed between a Client and a Professional is solely between those two parties. 0110 Design is not a party to these agreements and holds no liability for breaches of contract by either party.

3. User Responsibilities & Due Diligence

Users are solely responsible for conducting their own independent due diligence before hiring or contracting with any Professional found through the Service. This includes, but is not limited to, verifying active licenses, insurance coverage (such as Errors & Omissions or General Liability), past work references, and local regulatory standing.

4. Limitation of Liability

IN NO EVENT SHALL 0110 DESIGN, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR PROFESSIONAL ON THE SERVICE; OR (III) ANY ERRORS, OMISSIONS, DEFECTS, OR PROPERTY DAMAGE RESULTING FROM SERVICES RENDERED BY PROFESSIONALS HIRED VIA THE PLATFORM.

5. Indemnification

You agree to defend, indemnify and hold harmless 0110 Design and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
